Canada’s New Family Open Work Permits for Spouses of Temporary Residents

The Government of Canada has announced important changes to the rules for open work permits for the family members of international students and foreign workers. These changes are part of a larger effort to improve the country’s temporary resident programs and address economic needs.

The new guidelines, which will be effective on January 21, 2025, aim to make Canada’s immigration system fairer and better equipped to respond to economic changes. The government believes that these updates will not only support families but also help strengthen the nation’s economic situation.

Key Changes to Open Work Permit Eligibility

Starting January 21, 2025, the family Open Work Permits criteria will be stricter. The new requirements include:

  • Spouses of International Students: Only spouses of certain international students will be eligible for a family OWP. Specifically, this includes spouses of students enrolled in master’s programs that are 16 months or longer, doctoral programs, or select professional and eligible programs.
  • Spouses of Foreign Workers: Eligibility for family OWPs will be limited to spouses of foreign workers employed in TEER 0 or 1 occupations or select TEER 2 or 3 occupations in sectors with labour shortages or linked to government priorities. These sectors include natural and applied sciences, construction, health care, natural resources, education, sports, and military sectors.
  • Dependent Children: Dependent children of foreign workers will no longer be eligible for family OWPs under the new measures.
  • Existing OWPs: Work permits (OWPs) that were approved earlier and have not yet expired will still be valid. If students need extra time to finish their programs, or if family members received a shorter work permit than the main applicant, those family members in Canada can apply to renew their work permits. They must meet the same requirements as the current work permit, and the renewal duration should match the existing study or work permit of the principal applicant.
  • Spouses of Workers Covered by Free-Trade Agreements: These individuals and those transitioning to permanent residence will not be impacted by the changes.

Supporting Economic Goals

The updated OWP eligibility criteria are part of the government’s broader efforts to align immigration policies with Canada’s economic goals and labour market needs. By focusing on specific occupations and sectors experiencing labour shortages, the government aims to attract and retain talent that can drive innovation, productivity, and economic growth.

Enhancing the International Student Program

As part of the broader reforms, the government is also making changes to the International Student Program. These include a further reduction in the intake cap on international student study permits for 2025, based on a 10% reduction from the 2024 target of 485,000 new study permits issued. For 2025, this means issuing 437,000 new study permits, with the intake cap stabilizing in 2026.
